The Big Tech is Here to Stay! So Do the Regulations Governing the Same!

  • The global community has been witnessing some of the most cutting-edge awe-inspiring technological revolutions in the last few decades. Powered by the revolutionary introduction of information-technology-driven innovations, inventions, and developments, the universe is all set to embrace the latest emergence fully for the benefit of mankind. None of the global leaders representing their respective nations are willing to stay behind in acknowledging the importance of technological evolution. Hence, every country is in a rush to adopt the modern-day measures with absolute clarity and adequate funds to boot. The most prominent of the present-day technology is the mind-blowing ascendancy of Artificial Intelligence in such a short period.

  • AI promises to facilitate never-before aid and tools to humanity in literally every significant field. As the global community willfully embraces AI, the need to have in place regulatory measures assumes paramount importance. Thus, AI needs policing but over-policing will only hurt interests, including India. Note that governments everywhere must walk a tightrope in regulating AI. They must ensure that its development and use are safe for the public. But also, that its opportunities aren’t stifled. Because that could eventually circle back to hurting the public worse than ever. Against this backdrop, GOI’s recent advisory to various platforms related to AI is both welcome and needs to be cautioned.
  • Further, platforms deploying generative AI to offer their services to Indian users have been advised to do so only after appropriately labeling the inherent fallibility or unreliability of the output generated. This is the broad direction in which platforms need to be guided globally. Openly disclosing to consumers and seeking their consent before deploying any undertrial models is a vital safeguard. The trouble is with the idea of requiring explicit GOI permission before any AI/LLM/algorithm in the beta stage is deployed for users on the Indian internet. Such a straitjacket may impact domestic and international efforts very differently. The domestic ones are already at a David against Goliath’s disadvantage. Needless to mention, they need a lot of GOI support to have a shot at being competitive, not new red tape.

  • As for international platforms, imagine them bypassing testing in India. This may come to mean that something becomes widespread in the world without the input of our billion voices. Nobody wins a race by being left out of it. Yes, AI needs proper policing. Ahead of Lok Sabha elections, a particular set of dangers is very prominent. ECI has highlighted that AI and deepfakes can potentially undermine the level-playing field across democracies. It will certainly have to be on its toes over the coming months. Notably, big tech is taking voluntary measures to help prevent deceptive AI content from undermining election integrity in 2024. Regulation must be effective but not too restrictive. We must have measures in place that are smart, not heavy.
