Indian Bureaucracy: Checks and Balances!

  • With an eye to increase efficiency in performances of the bureaucracy, Prime Minister Narendra Modi has initiated measure termed ‘Pragati’ and in one of his recent reviews, called for tougher action against those officials facing barrage of complaints. Government programmes, if it has to see the light of day, heavily leans on the civil services for implementation / execution.  Promises of the governments’ development agenda shall be delivered effectively only if the officials entrusted with such tasks are held accountable and answerable backed up by relevant supportive laws.
  • Government exercises regulatory controls and powers viz,. All India Service Rules to compulsorily retire below performing / substandard bureaucrats after 15 years of service. Political-bureaucratic nexus is well documented and runs so deep; it apparently calls for decisive action to break the same.  In an attempt to break this malaise,   Modi government has shown door to more than handful of the deadwood bureaucrats for non-performance.  Notably, the Apex Court too backed this move way back in 1980 by stating that compulsory retirement “is undoubtedly in the public interest and is not passed by way of punishment”.
  • To usher in more accountability, successive Pay Commissions too recommended performance based pay structure, at par with private sector entities, whose sole criterion is noteworthy, if not acceptable action(s). In fact, 7th Pay Commission for Central Government employees too has strongly recommended performance related pay for all categories instead of the presently followed yearly increments irrespective of tangible performances or otherwise.  Above applies to all such cases where performances are not up to the scratch.

 

  • What happens to those who does perform admirably and meets expectations whilst executing government backed developmental measures? Remember, substantial developmental activities of the government are carried out by private sectors where firms would come on board only if profit is assured.  As such, bureaucrats’ career interests’ whilst discharging intended responsibilities deserves to be protected under the law.  In this respect, any decision making might provoke questions from different quarter’s vis-à-vis uncompromised integrity, fair assessment, meticulous adherence to procedural formalities, right up to award of contract and passing of bills.
  • A minor irritant for the decision making process of honest bureaucrats is a clause in Prevention of Corruption Act that views taking any such decisions benefiting somebody can be deemed an act of corruption even in the absence of a quid-pro-quo. This dissuades quick decisions in the award of contracts and on a flipside, encourages indecisiveness / inaction from the officials.  There are any numbers of instances where retired bureaucrats are under the scanner for pursuing their tasks with sincerity.

 

  • Provisioning adequate protections in the law for honest bureaucrats in executing tasks would propel speedy developmental measures in the country no matter which party governs at the Centre. Therefore, need of the hour is to revisit this particular aspect and strengthen the hands of the bureaucrats by precisely enacting such measures. Therefore, onus squarely rests with the Government to reinforce the existing laws.
